- San Nicolas was nominated by Governor David M. Apatang on February 9, 2026, to fill a Superior Court vacancy and confirmed by the CNMI Senate on April 24, 2026.
- He took the judicial oath on May 8, 2026, at Guma’ Hustisia, marking him as the Commonwealth’s first judge from Tinian.
- In his oath ceremony, San Nicolas emphasized that “this office is not about power.
- It is about service” and pledged to uphold the CNMI Constitution, laws, and the principles of fairness and impartiality.
- He thanked Governor Apatang, the Senate, his family, mentors including Chief Justice Alexander C. Castro, and the judiciary’s staff for their support
