Source page 3All scheduling inquiries and inquiries relating to the status of the conference (i.e. whether it is in person or virtual) shall be directed to the Part e-mail.
Source page 3Conference Appearances: Appearing counsel (and self-represented litigants) must be both fully familiar with the case and authorized to enter into binding agreements on all aspects of the case. The failure of any counsel or self-represented litigant to appear for a conference may be treated by the Court as a default and may result in the dismissal of a complaint or petition, the striking of any answer, or by another appropriate remedy, as authorized by Uniform Rule § 202.27. In matrimonial actions, litigants must appear with their counsel for all conferences, unless the Court excuses such appearance.
Source page 3Adjournments of Conferences: For e-filed cases, a request to adjourn a conference must be made in writing and filed to NYSCEF at least forty-eight (48) hours in advance of the scheduled conference.
Source page 3For non-e-filed cases, a request to adjourn a conference must be made via the Part e-mail with all parties copied, at least forty-eight (48) hours in advance of the scheduled conference.
Source page 3Exceptions for emergencies and/or belated adjournment requests may be permitted if an adequate reason is provided to the Court, and in that case, the adjournment request must be sent by e-mail to the Part email.
Source page 3All adjournment requests must set forth: (1) the reason for the adjournment; (2)
Source page 3whether the opposing party consents or objects to the request; (3) the length of the adjournment sought or, if on consent, a date all parties are available; and (4) the number of prior adjournment requests and corresponding dates thereof. All adjournment requests must be made on notice to all counsel and self-represented litigants.
Source page 4Opposing counsel or self-represented litigants may succinctly provide their reasons for objecting to the requested adjournment if the objection set forth by the requesting party is stated incorrectly. The request and response shall not be used to advocate a position on the substantive dispute.
Source page 4Counsel scheduled to appear before this Court and another Court must communicate that fact to the Part at least 48 hours prior to the date of the appearance so that counsel’s conflicting appearances can be reconciled. Counsel shall e-file an Affirmation of Engagement. Counsel should not rely on opposing counsel to advise the Court of the conflict when the case is called. If counsel fails to comply, the Court may proceed in that counsel’s absence.
Source page 4Preliminary Conferences:2 The Court will schedule a Preliminary Conference within forty-five (45) days after a Request for Judicial Intervention (RJI) has been filed on a matter. The requesting party will be notified by the Part Clerk as to the date and time as well as provided with this Part’s Preliminary Conference Order form (proposed).
Source page 4All counsel and self-represented litigants must abide by and comply with the Court’s discovery schedule and deadlines set forth in the Preliminary Conference Order. No modifications of the dates set by the Court are permitted except by order of the Court.
Source page 4In all matters, except contested matrimonial actions, if all parties are represented by counsel, appearances at the Preliminary Conference will be waived if a completed Proposed Preliminary Conference Order is received by the Court no later than three (3) business days prior to the scheduled Preliminary Conference date.
Source page 4Settlement Conferences: Appearing counsel must have the appropriate authority to discuss factual and legal issues, settlement demands or offers. This means that counsel for the plaintiff(s) must be prepared to make a settlement demand, and counsel for the defendant(s) must be prepared to respond to the demand. Where a party is being
Source page 4To foster open settlement discussions, the Court may meet with counsel separately during the settlement conference. Unless an objection is stated, counsel is presumed to have consented to the Court doing so.
Source page 5Trial Scheduling Conferences: A Trial Scheduling Conference will be scheduled 60 days after the filing of the Note of Issue if no dispositive motions are filed. Trial dates are discussed at a Trial Scheduling Conference and assigned by order of the Court or other written communication. To schedule trial dates, the Court needs to know the length of trial, the number of witnesses and how long each witness is projected to testify. Thus, the parties shall e-mail the Court a schedule of witnesses identifying all witnesses, their addresses and how long each witness is projected to testify on direct, cross, and re-direct examination at least 24 hours prior to the Trial Scheduling Conference, otherwise the Trial Scheduling Conference will be cancelled. Once the trial dates are scheduled, the number of days cannot be increased. Generally, there are five hours per day of trial time. Unless the court directs otherwise, the parties shall agree to time estimates anticipated for all aspects of trial and email their agreed-upon estimates at least 24 hours prior to the Trial Scheduling Conference. If the parties cannot reach an agreement, the parties shall submit competing proposed estimates to the court at least 24 hours before the Trial Scheduling Conference. Opening statements may not exceed 20 minutes and closing statements may not exceed one hour unless an extension is requested and good cause is shown.
Source page 5Pre-Trial Conferences: A Pre-Trial Conference with all counsel and self- represented litigants will be scheduled to finalize witness scheduling, and when a jury trial, to finalize draft jury charges and verdict sheets. For jury trials, at least 10 days prior to the Pre-Trial Conference, the parties shall e-mail (in MS Word) and e-file the proposed jury charges and verdict sheet with a side-by-side comparison identifying any areas of disagreement: joint jury charges, verdict sheet, and jury questionnaire. The court directs the parties to meet and confer concerning proposed jury charges and verdict sheet before their submission to the court. Where a proposed jury instruction is verbatim from the most current edition of the Pattern Jury Instructions (PJI), PJI citations are sufficient; if a proposed instruction modifies any PJI instruction, the submitting party must include a cover letter providing appropriate authority for the proposed modifications and a red-line version demonstrating all changes to the PJI language. The parties may request sample jury instructions and verdict sheets by e- mailing the Part.
Source page 5Requesting a Discovery Conference: Do not wait until the compliance conference to bring a discovery dispute to the Court’s attention. To request a discovery conference after the parties have met and conferred, the requesting party shall send the request by
Source page 6[Index number, case name].” The requesting party shall provide a brief statement, not more than 500 words, identifying the unresolved dispute(s) and, if the party believes it would be helpful, requesting authorization to submit individual pre-conference letters.
Source page 6Individual Pre-Conference Letters: If permission to submit such is granted, the parties shall e-file pre-conference letters of no more than 1,500 words at least 48 hours prior to the scheduled conference.
Source page 6Exchange of Electronically Stored Information (ESI): Where applicable, counsel shall discuss ESI with their clients and then meet and confer with opposing counsel. The parties shall attempt, in good faith, to reach an agreement regarding the scope of ESI to be sought, the location, format, and custodians of such information, the burden of bearing costs for collecting/reviewing such information, and the amount of time anticipated to obtain, review, and produce such information. The parties shall also discuss how to address filing sharing techniques (e.g., links that expire).
Source page 6Discovery Motions: Discovery motions are not permitted unless specifically authorized or directed by the Court. Any discovery motion shall be brought by Order to Show Cause.
Source page 6General Rules: Written applications by notice of motion (or notice of petition) must be made returnable at 9:30 a.m. on any Thursday this Court is in session.
Source page 7All motion papers must comply with 22 NYCRR § 202.8-b. Pursuant to 22 NYCRR § 202.8-b(a)(i-ii), absent express permission obtained in advance from the Court, affidavits, affirmations, briefs, and memoranda of law in chief shall be limited to 7,000 words each. Reply affidavits, affirmations, and memoranda of law shall be no more than 4,200 words and shall not contain any arguments that do not respond or relate to those arguments made in the memoranda in chief. Papers exceeding these limitations may not be considered and may be rejected by the Court.
Source page 7Motion papers are limited to moving papers, opposing papers, including cross- motions, and reply papers (except that reply papers are not permitted on orders to show cause without advance permission from the Court). Reply papers are not permitted on a cross-motion. Sur-reply papers are not permitted in any instance, except by express permission from the Court.
Source page 7No oral argument will be scheduled on the motion return date unless directed by the Court. Parties seeking oral argument can request it by conspicuously writing, “Oral Argument Requested” above the index number on the first page of the submitted papers. Parties will be notified if the Court grants such request.
Source page 7Except by permission from the Court, all motion papers and proposed orders to show cause must be typed (12-point), double-spaced, securely bound, and fully legible.
Source page 7Unless directed otherwise by the Court, the filing of a motion does not relieve any party from attending any previously scheduled Court appearances, regardless of the nature of the relief sought in the motion.
Source page 7Orders to Show Cause: The following motions shall be brought by Order to Show Cause – to be relieved as counsel, pro hac vice, discovery motions, seal motions, contempt, all motions and cross-motions in matrimonial actions and motions in limine.
Source page 7This Part requires notice to all counsel of Orders to Show Cause, unless good cause is provided for ex parte relief. If a TRO is sought, the court will e-mail the parties if it requires argument on the TRO.
Source page 7In non-e-filed cases, proposed Orders to Show Cause submitted for consideration must include an e-mail address to permit a conformed copy of the signed
Source page 7Any proposed Order to Show Cause shall include a space for the Court to set forth a briefing schedule for opposition papers, and, if necessary, an appearance date.
Source page 8Dispositive Motions: Summary judgment motions shall be initiated within 60 days of the deadline to file the note of issue unless the Court directs otherwise. If a summary judgment motion is filed, the court will accept the use of stipulated Joint Statements of Undisputed Fact(s) to reduce duplicated and/or unnecessary submissions and to narrow the scope of the disputed issues/facts. Accordingly, the parties are required to meet and confer, prior to filing any motion for summary judgment (other than those pursuant to CPLR 3213), to attempt in good faith to reach and memorialize a joint statement of their agreed-upon facts. A Joint Statement of Undisputed Fact(s) may be cited in the parties’ legal memoranda. When a summary judgment motion is made prior to the completion of discovery, such motion does not stay discovery.
Source page 8Motions to Amend: Motions seeking leave to amend a pleading shall be accompanied by a copy of the original pleading, a clean copy of the proposed amended pleading, and a red-line copy identifying all modifications or additions.
Source page 8Motion Formatting: All motions papers shall contain the index number and motion sequence number. Every motion shall include a memorandum of law (22 NYCRR § 202.8[c] [“Affidavits shall be for a statement of the relevant facts, and briefs shall be for a statement of the relevant law”]). Parties shall cite to the NYSCEF record where possible. All citations to NYSCEF record/docket in all motion papers require NYSCEF Document Numbers with a descriptive label and pinpoint citations to NYSCEF page number (e.g., NYSCEF 1, Complaint ¶1). All motions papers shall be e-filed in connection with the appropriate motion sequence number. All e-filed papers and documents shall be searchable.
Source page 8Motion Exhibits: For hard copy filings, all exhibits must be labeled with external tab markings. Plaintiffs shall designate exhibits by P and then number, and defendants shall designate exhibits by D and then number. Exhibit numbering may not begin anew for subsequent papers submitted on the same motion by the same party.
Source page 8For e-filed motions, each exhibit must be separately e-filed and may not be submitted as one collective exhibit. Exhibits failing to comply may not be considered and may be rejected by the Court. Counsel and self-represeented litigants must use appropriate document titles when uploading items through NYSCEF and include a description. Every document shall have a description that identifies exactly what it is: if “Exhibit 1” is a Rental Agreement, for example, label the document “Rental Agreement for 123 Main Street.” If a movant files an electronic submission that does not comply with this requirement, he/she will be given one opportunity to remedy the submission, or the motion will be denied.
Source page 8Deposition/examination-before-trial transcripts included as exhibits must be single, front-faced pages only. Parties may submit four-per-page manuscripts. Parties shall designate relevant portions using pages and line numbers in their motion papers.
Source page 9Unsigned deposition transcripts will not be considered on motions for summary judgment unless it is demonstrated that the transcript was forwarded to the deponent for review and signature in compliance with CPLR 3116(a).
Source page 9Adjournments of Motions: A request to adjourn a motion return date must be made in writing and submitted via NYSCEF. The requesting party must file an adjournment request via NYSCEF as a “Motion Document (document relating to an existing motion)” relating to the specific motion sequence sought to be adjourned, and the request shall be filed as an “Adjournment of Motion – Request.” In the “Additional Document Information” box, the filing party must state, “Request to Adjourn Motion [Not] On Consent.”
Source page 9All motion adjournment requests must set forth (1) the reason why an adjournment is necessary; (2) whether the opposing party(ies) consent(s) or object(s) to the application; (3) the length of the adjournment sought; and (4) the number of prior adjournment requests and the dates previously set. Opposing counsel or a self- represented party may succinctly provide their reasons for objecting to the requested adjournment if it is believed that his/her position has been stated incorrectly. Following the same instructions as above, the opposition letter must be filed as an “Adjournment of Motion – Opposition to Request.”
Source page 9No more than three (3) adjournments of any motion or cross-motion are permitted. The total period of time that a motion may be adjourned shall not exceed sixty (60) days from the original return date. The Court will advise the requesting party by NYSCEF whether the requested adjournment has been granted and the new return date for the motion. The parties should not assume that the request for adjournment (even if on consent) has been granted unless specifically advised by the Court.
Source page 9Transcripts: Movants shall e-file transcripts of court proceedings, under the appropriate motion sequence number where applicable. Only certified transcripts are accepted. If movant has not received the transcript from the reporter within 30 days of the proceeding, the movant shall email the Part Clerk. Parties shall note the court reporter’s name and contact information at the beginning of the appearance. If there are corrections to the transcript, the parties shall adhere to the deadlines set forth in CPLR 5525(c). Absent a stipulation or timely notice to the court of changes to the transcript, the court may so-order the transcript as received. Non-compliance with any deadline set forth under CPLR 5525(c) is a waiver.
Source page 9All requests to “So Order” a subpoena must be emailed to the Part e-mail after the subpoena has been e-filed via NYSCEF.
Source page 10Interpreters: In the event that any party requires the services of an interpreter or services for the hearing impaired, the Part Clerk must be notified no later than the Pre-Trial Conference so that the appropriate arrangements can be made.
Source page 10Jury Selection and Contact: Juries will be selected pursuant to 22 NYCRR § 202.33. Counsel shall not read from any pleading, part of a pleading, or other document during jury selection. Counsel shall not refer to any specific amount of money being sought. Counsel shall not discuss any aspect of the law with the jury. Instruction on the law is for the Court alone. In jury trials, the parties and their attorneys must stand (if physically able) whenever the jury enters or leaves the courtroom. Non-party witnesses shall not be in the courtroom during the trial except, when the non-party witness is testifying.
Source page 10Reading of Exhibits: If counsel intends to use/read from any anticipated exhibit or item of demonstrative evidence during opening statements, counsel must advise the Court of such intention prior to the commencement of jury selection.
Source page 10Objections: Objections to questions at trial shall be limited to the objecting party standing (if physically able) and stating, “Objection,” and no more than one word or two words as to the basis for the objection. Speaking objections shall not be made. If the Court requires further explanation of the objection, the Court will invite counsel to approach at side bar.
Source page 10Use of Recordings: To allow the Court to rule on the admissibility of a recording at trial or a hearing, any party intending to use a recording must submit a copy of the recording and transcript of the recording, if applicable, to the Court at least three (3) weeks prior to the scheduled trial or hearing date. Any proposed objections to the recording must be submitted at least two (2) weeks prior to the scheduled trial or hearing date.

If an agreement cannot be reached between and among the parties as to the questions to be posed to the jury prior to the pre-trial conference following diligent, good faith efforts, each party will present a proposed verdict sheet which will be served upon all the parties. Proposed verdict sheets must be submitted in writing and by email in Microsoft Word format to the Part e-mail.
Source page 11Where the Court issues a Bench Decision, movant shall e-file and e-mail the Part e-mail a copy of the certified transcript of the proceedings at which the Bench Decision was rendered to be “So Ordered.” In non-e-filing cases, the transcript shall be submitted to the Part e-mail. The Court may require movant to submit a proposed order. Proposed orders must be also emailed in a Microsoft Word document in addition to e-filling on NYSCEF.
Source page 12Orders, judgments, counter-orders, and/or counter-judgments submitted for signature on notice will be returned unsigned unless an affidavit of service and notice of settlement for a date designated in accordance with 22 NYCRR § 202.48 has been included. Proposed judgments must be emailed in a Microsoft Word document in addition to e-filling on NYSCEF.
Source page 12Counsel must notify the Court, by email to the Part, of the settlement or withdrawal of any action or proceeding immediately upon such settlement or withdrawal. A copy of the signed stipulation of discontinuance, which has or will be submitted to the County Clerk, shall be emailed to the Part so that the matter may be marked disposed. Stipulations of Partial Discontinuance shall be e-filed using the proper designation to avoid discontinuance of the entire action.
Source page 12In those cases where a party is obligated to make payments over time, the parties shall file a Stipulation of Discontinuance without prejudice. The Court will not allow counsel to hold the Stipulation of Discontinuance until all payments are made.
Source page 12If a case pending before this Court is stayed by another Court (i.e., by virtue of a bankruptcy proceeding), counsel shall immediately file a letter via NYSCEF advising the Court of such stay and proof (i.e. Notice of Bankruptcy, court order, etc.). If, and when, the stay is lifted by the other Court, counsel shall immediately file a letter via NYSCEF advising the Court of the same.
Source page 12Motions: All motions must include a proposed order which disposes of the motion or application for the Court’s signature. Motion templates mandated for statewide residential foreclosure cases, where the homeowner has defaulted, must be used and are available on nycourts.gov.
Source page 12Substitution of Referee: Requests to substitute a Referee shall be made by letter to the Court, not by formal motion, and must include a proposed order to appoint a substitute referee. 12
Source page 12Discontinuance: Where an agreement has been reached to modify a loan, the parties shall submit a stipulation discontinuing the action.
Source page 13Judgment of Foreclosure and Sale: All proposed Judgments of Foreclosure and Sale submitted to the Court shall comply with the form set forth in the motion templates and must include public notice of the time and sale will be made in The Journal News (Rockland).
Source page 13Surplus Monies Proceeding: A Judgment of Foreclosure and Sale executed by this Court will also set forth a date and time for a post-foreclosure sale ‘Surplus Monies’ status conference. Plaintiff’s counsel shall notify the appointed Referee of the Surplus Monies status conference date and time (and provide the Microsoft Teams virtual conference access information to the extent such conference is scheduled to proceed remotely using Microsoft Teams). Appearances by the parties and the appointed Referee are required in the manner set forth in the Judgment unless: (1) a completed Foreclosure Action Surplus Monies Form has been filed and received by the Court at least one week prior to the conference date, or (2) the Referee notifies the Court in writing at least one week prior to the conference date that the sale has not/will not occur prior to the conference date and requests a new conference date to be scheduled subsequent to the anticipated foreclosure sale date.
Source page 13Contested Matrimonial Preliminary Conferences: Counsel must be familiar, and comply, with the provisions of 22 NYCRR § 202.16. Prior to the Preliminary Conference, the parties must file and exchange those documents set forth in 22 NYCRR § 202.16(f)(1), including Net Worth Statements, pay stubs, W-2 statements, tax returns, and statements of accounts.
Source page 13In the event either party fails to comply with this provision of the Part Rules, the Court may adjourn the conference and assess costs and fees against the party who failed to comply. If both sides fail to comply, the Court may deem such non-compliance to be a withdrawal of the request for a conference and cancel same, requiring payment of a second fee or the Court may treat the failure as a default under Court Rule § 202.27(c) authorizing the Court to strike pleadings or impose other sanctions.
Source page 13Counsel must have substantive communications before the date set for the Preliminary Conference, either in person or telephonically, to determine the issue to be litigated. The scope of discovery shall be discussed at the conference so that the Court can determine if the requested items are necessary and/or to set dates for compliance with the demands. Counsel must inform their clients of the automatic orders created by DRL § 236(B)(2)(b) as soon as the client-attorney relationship is formed.
Source page 14Parties to matrimonial actions must appear at all matrimonial conferences unless otherwise directed by the Court.
Source page 14Contested Matrimonial Motion Practice: As noted above, all motions (including cross motions) in matrimonial actions must be made by Order to Show Cause. Both parties and counsel must appear on the return date of any motion brought, unless otherwise directed by the Court in the Order to Show Cause.
Source page 14On the return date of any pendente lite motion, the Court will conduct either a Preliminary Conference or a conference on the motion, as appropriate. In the event a Bench Decision (ruling) is issued on the motion, or counsel verbally places the terms of a resolution of any such motion on the Court’s record, counsel shall promptly order a copy of the transcript and submit the same to be “So Ordered” by this Court. The cost of such transcript shall be shared by the parties unless otherwise ordered.
Source page 14Contested Matrimonial Pre-Trial Conferences: On or before the Pre-Trial Conference, counsel and any self-represented litigant must provide a Trial Notebook in accordance with this Court’s rules hereinabove and containing the following
Source page 15The Court will review all uncontested matrimonial materials submitted on an “as received” basis. Working copies are not required. Counsel or self-represented parties will be advised of any deficiencies in the papers submitted by Court Notice, which will identify the defective document(s), describe the defect(s), and provide a date by which the defect(s) must be cured. All deficiencies in the papers must be cured by the date in the Court notice or the matter will be dismissed (without prejudice to refile on proper papers).
Source page 15Except in cases where an attorney is replaced by another attorney on consent, any change or withdrawal of counsel must be approved by the Court on a motion brought by Order to Show Cause pursuant to CPLR 321. Corporate entities must be represented by counsel (CPLR 321). Counsel is not relieved until a court order is issued granting such relief. If counsel wishes to stay the action for 30 days, counsel may seek such relief via a TRO. If a TRO is not sought, the action is not stayed.
Source page 16The Court does not recognize the purported withdrawal by counsel where such withdrawal would result in a party becoming self-represented (except where the party is an attorney) by the filing of a “Consent to Change Attorney” form. The use of a “Consent to Change Attorney” to withdraw where a party becomes self-represented is specifically prohibited. This Court also does not accept substitution of counsel forms from attorneys to self-represented litigants.
